Pursuant to Art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) the so-called GDPR, we inform you that:
I. Data controller:
We would like to inform you that the personal data administrator is Attorney Agata Wengerska, running a business under the name Kancelaria Adwokacka Adwokat Agata Wengerska with its registered office at street Sobieskiego 19a, 44-200 Rybnik.
II. Purposes of personal data processing:
Personal data are processed solely for the purpose of performing legal activities and providing advisory services.
III. Legal basis for the processing of personal data:
Personal data are processed pursuant to Art. 6, section 1, point a, b, c, f GDPR:
- processing is necessary for the performance of a contract to which the data subject is party or to take action at the request of the data subject before concluding the contract;
- processing is necessary to fulfill the legal obligation imposed on the administrator, in particular with regard to tax and accounting obligations;
- for debt collection purposes as a legitimate interest of the administrator;
- in order to conduct correspondence, including electronic correspondence, as a legitimate interest of the administrator.
IV. Recipients of personal data:
Only authorized employees/collaborators/subcontractors have access to personal data in order to perform their official duties, as well as entities providing IT, accounting, hosting and e-mail services.
V. Transfer of personal data to third countries or international organizations:
Personal data is not transferred to third countries or international organizations.
VI. Personal data storage period:
Personal data will be processed for 10 years from the end of the year in which the proceedings in which personal data were collected in the scope of data processed in the course of practicing the profession of lawyer ended. In other cases, personal data will be processed for as long as required by applicable law, in particular tax and accounting regulations, and for as long as it is necessary to establish, pursue or defend claims.
VII. Rights of the data subject:
You have the right to:
- access to personal data, provided that its implementation does not violate the lawyer’s obligation to maintain secrecy (Article 15, section 1 of the GDPR),
- receiving a copy of personal data, provided that its implementation does not violate the lawyer’s obligation to maintain secrecy (Article 15, section 3 of the GDPR),
- rectification or updating of personal data (Article 16 of the GDPR),
- deletion of personal data – if in your opinion there are no grounds for the Administrator to process your data, you may request that the Administrator delete them, except for situations where the obligation to process personal data results from a legal provision or the processing of data is necessary for the investigation, determination or defense of claims (Article 17 of the GDPR),
- limiting the processing of personal data, as long as its implementation does not violate the lawyer’s obligation to maintain secrecy (Article 18 of the GDPR),
- transfer your personal data, i.e. to receive information from the Administrator about the personal data being processed, in a structured, commonly used, machine-readable format only to the extent that personal data are processed for the purpose of concluding and performing a contract and are processed in an automated manner (Article 20 of the GDPR),
- submit a complaint to the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the provisions of the GDPR.
If the basis for the processing of personal data is the legitimate interest of the administrator, you have the right to object to the processing of personal data (Article 21 of the GDPR), with the exception of personal data obtained by the administrator in connection with the provision of legal assistance. VII. Information on the obligation to provide personal data and the consequences of failure to provide it:
Providing personal data is voluntary in order to conclude and perform the contract and to implement the legitimate interest of the administrator. In other cases, providing data is mandatory, in particular when required to fulfill the legal obligation imposed on the administrator.
